What You Need to Do at the First Stages of Your Divorce

If you are about to go through a divorce or have recently filed for divorce, then they're a few steps that you may consider taking to put yourself in the best position later on in the process.

  • Don't hire the same attorney as your spouse. If you use the same attorney as your spouse, a conflict of interest can easily arise. You want to make sure that you hire a lawyer that can represent your rights alone.
  • File a petition for temporary relief. Make sure that you protect your assets by filing a petition for temporary relief. This will prohibit you and your spouse from taking on more debt, selling property, loaning property, or giving away assets. It can also identify the spouse that will pay the bills and set out a temporary parenting plan.
  • Get full disclosure about financial assets. Ask for your spouse to give you a financial affidavit that states their income source and debts under oath. No matter how well you think you know your spouse, you don't want to later find out that they were holding out on certain accounts.
